Ide o r&aacute;mcov&uacute; &uacute;pravu vz\u0165ahov z&aacute;konodarnej a v&yacute;konnej zlo\u017eky moci v oblasti z&aacute;le\u017eitost&iacute; E&Uacute;. Tento &uacute;stavn&yacute; z&aacute;kon dosia\u013e nebol zmenen&yacute; ani doplnen&yacute;, a tak niektor&eacute; jeho ustanovenia nezodpovedaj&uacute; terminol&oacute;gii Lisabonskej zmluvy, \u010do v&scaron;ak nem&aacute; vplyv na re&aacute;lne postavenie n&aacute;rodnej rady v z&aacute;le\u017eitostiach E&Uacute;.<\/p>\r\n<p style=\"text-align: justify;\"><strong>Vz\u0165ah n&aacute;rodnej rady a vl&aacute;dy v z&aacute;le\u017eitostiach E&Uacute; <\/strong>m&aacute; v z&aacute;sade dve roviny - povinnos\u0165 vl&aacute;dy predklada\u0165 ur\u010den&eacute; materi&aacute;ly a pr&aacute;vomoc n&aacute;rodnej rady schva\u013eova\u0165 stanovisk&aacute; Slovenskej republiky. <br \/>Vl&aacute;da alebo poveren&yacute; \u010dlen vl&aacute;dy predklad&aacute; n&aacute;rodnej rade n&aacute;vrhy pr&aacute;vne z&aacute;v&auml;zn&yacute;ch aktov a in&yacute;ch aktov E&Uacute;, o ktor&yacute;ch bud&uacute; rokova\u0165 z&aacute;stupcovia vl&aacute;d \u010dlensk&yacute;ch &scaron;t&aacute;tov E&Uacute;, a informuje n&aacute;rodn&uacute; radu o ostatn&yacute;ch z&aacute;le\u017eitostiach s&uacute;visiacich s \u010dlenstvom Slovenskej republiky v E&Uacute;. <br \/>Tieto n&aacute;vrhy m&aacute; n&aacute;rodn&aacute; rada k dispoz&iacute;cii nielen od vl&aacute;dy, ale s&uacute; v r&aacute;mci tzv. Barrosovej iniciat&iacute;vy zasielan&eacute; aj priamo n&aacute;rodn&yacute;m parlamentom (2). Okrem toho vl&aacute;da predklad&aacute; n&aacute;rodnej rade aj n&aacute;vrhy stanov&iacute;sk Slovenskej republiky k n&aacute;vrhom pr&aacute;vne z&aacute;v&auml;zn&yacute;ch aktov a in&yacute;ch aktov E&Uacute;, pri\u010dom ich s&uacute;\u010das\u0165ou je najm&auml; odhad ich vplyvu a dosahu na Slovensk&uacute; republiku (3).<br \/>N&aacute;rodn&aacute; rada m&aacute; pr&aacute;vomoc (mo\u017enos\u0165) schva\u013eova\u0165 stanovisk&aacute; Slovenskej republiky k n&aacute;vrhom pr&aacute;vne z&aacute;v&auml;zn&yacute;ch aktov a in&yacute;ch aktov E&Uacute;, o ktor&yacute;ch sa rozhoduje na &uacute;rovni z&aacute;stupcov vl&aacute;d \u010dlensk&yacute;ch &scaron;t&aacute;tov E&Uacute;. <br \/>Z tejto pr&aacute;vnej &uacute;pravy vypl&yacute;va teda pr&aacute;vo n&aacute;rodnej rady, nie v&scaron;ak povinnos\u0165, vyjadrova\u0165 sa k stanovisk&aacute;m vl&aacute;dy k n&aacute;vrhom pr&aacute;vnych aktov E&Uacute;. <br \/>N&aacute;rodn&aacute; rada m&ocirc;\u017ee (ale nemus&iacute;) schva\u013eova\u0165 stanovisk&aacute; Slovenskej republiky aj k \u010fal&scaron;&iacute;m z&aacute;le\u017eitostiam E&Uacute;, ak ju o to po\u017eiada vl&aacute;da alebo najmenej p&auml;tina poslancov n&aacute;rodnej rady. <br \/>Aj v tomto pr&iacute;pade ide o pr&aacute;vo n&aacute;rodnej rady, ale nie o povinnos\u0165 vyjadrova\u0165 sa aj k in&yacute;m z&aacute;le\u017eitostiam E&Uacute;. &Uacute;stavn&yacute; z&aacute;kon \u010d. 397\/2004 Z. z. stanovuje pr&aacute;vne &uacute;\u010dinky pre pr&iacute;pady, ke\u010f n&aacute;rodn&aacute; rada:<br \/>- schv&aacute;li n&aacute;vrh stanoviska Slovenskej republiky;<br \/>- nevyjadr&iacute; sa k n&aacute;vrhu stanoviska Slovenskej republiky<br \/>v lehote dvoch t&yacute;\u017ed\u0148ov od jeho predlo\u017eenia;<br \/>- neschv&aacute;li n&aacute;vrh stanoviska Slovenskej republiky ani in&eacute; stanovisko v tej istej veci.<\/p>\r\n<p style=\"text-align: justify;\">Ak n&aacute;rodn&aacute; rada schv&aacute;li n&aacute;vrh stanoviska Slovenskej republiky, \u010dlen vl&aacute;dy je t&yacute;mto stanoviskom viazan&yacute; pri zastupovan&iacute; Slovenskej republiky v pr&iacute;slu&scaron;nom org&aacute;ne E&Uacute;. \u010clen vl&aacute;dy sa m&ocirc;\u017ee od stanoviska Slovenskej republiky odch&yacute;li\u0165 len v nevyhnutnom pr&iacute;pade a so zrete\u013eom na z&aacute;ujmy Slovenskej republiky; v takom pr&iacute;pade je povinn&yacute; o tom bezodkladne informova\u0165 n&aacute;rodn&uacute; radu a tak&yacute;to postup od&ocirc;vodni\u0165. <br \/>\u010clen vl&aacute;dy m&ocirc;\u017ee po\u017eiada\u0165 n&aacute;rodn&uacute; radu o zmenu stanoviska Slovenskej republiky (4).<br \/>Ak sa n&aacute;rodn&aacute; rada nevyjadr&iacute; k n&aacute;vrhu stanoviska Slovenskej republiky do dvoch t&yacute;\u017ed\u0148ov od jeho predlo\u017eenia, \u010dlen vl&aacute;dy je viazan&yacute; (predlo\u017een&yacute;m) n&aacute;vrhom stanoviska Slovenskej republiky (5). <br \/>Mo\u017enos\u0165 sa ku n&aacute;vrhu stanoviska nevyjadri\u0165 (tzv. princ&iacute;p tichej proced&uacute;ry) je prejavom mo\u017enosti stanovisko vzia\u0165 na vedomie resp. &bdquo;ml\u010dky&ldquo; ods&uacute;hlasi\u0165 a v&ocirc;bec ho neprerokov&aacute;va\u0165 ani explicitne neschva\u013eova\u0165. <br \/>Ak sa n&aacute;rodn&aacute; rada rozhodne nevyjadri\u0165 sa, vl&aacute;da bude v org&aacute;noch E&Uacute; prezentova\u0165 tak&eacute; stanovisko, ktor&eacute; si k danej veci pripravila a predlo\u017eila n&aacute;rodnej rade. <br \/>T&aacute;to mo\u017enos\u0165 m&aacute; vyu\u017eitie napr&iacute;klad pri margin&aacute;lnych ot&aacute;zkach, pri ktor&yacute;ch by prerokov&aacute;vanie a schva\u013eovanie bolo len nadbyto\u010dn&yacute;m procedur&aacute;lnym za\u0165a\u017een&iacute;m n&aacute;rodnej rady na &uacute;kor rozsiahlej&scaron;&iacute;ch ot&aacute;zok so &scaron;ir&scaron;&iacute;m nadn&aacute;rodno-politick&yacute;m dosahom.<br \/>Ak n&aacute;rodn&aacute; rada neschv&aacute;li n&aacute;vrh stanoviska Slovenskej republiky a z&aacute;rove\u0148 neschv&aacute;li v danej veci in&eacute; stanovisko, \u010dlen vl&aacute;dy je viazan&yacute; (predlo\u017een&yacute;m) &aacute;vrhom stanoviska Slovenskej republiky (6). <br \/>Tento princ&iacute;p je analogick&yacute; k tzv. princ&iacute;pu kon&scaron;trukt&iacute;vneho nes&uacute;hlasu.<br \/>Okrem toho n&aacute;rodn&aacute; rada najmenej raz za rok na z&aacute;klade spr&aacute;vy podanej vl&aacute;dou rokuje o z&aacute;le\u017eitostiach s&uacute;visiacich s \u010dlenstvom Slovenskej republiky v E&Uacute; a schva\u013euje odpor&uacute;\u010dania pre vl&aacute;du v nasleduj&uacute;com obdob&iacute; (7).<\/p>\r\n<p style=\"text-align: justify;\"><strong>V&yacute;bor N&aacute;rodnej rady Slovenskej republiky pre eur&oacute;pske z&aacute;le\u017eitosti<\/strong><\/p>\r\n<p style=\"text-align: justify;\">Pod\u013ea &uacute;stavn&eacute;ho z&aacute;kona \u010d. 397\/2004 Z. z. m&ocirc;\u017ee n&aacute;rodn&aacute; rada vykon&aacute;van&iacute;m p&ocirc;sobnosti v z&aacute;le\u017eitostiach E&Uacute; z&aacute;konom poveri\u0165 svoj v&yacute;bor. To znamen&aacute;, \u017ee pokia\u013e sa n&aacute;rodn&aacute; rada uznesie, \u017ee v&scaron;etka eur&oacute;pska agenda, ktorou sa rozhodne zaobera\u0165, nebude prerokov&aacute;van&aacute; na sch&ocirc;dzi n&aacute;rodnej rady, m&ocirc;\u017ee na tento &uacute;\u010del zriadi\u0165 nov&yacute; v&yacute;bor alebo poveri\u0165 touto p&ocirc;sobnos\u0165ou in&yacute;, u\u017e existuj&uacute;ci v&yacute;bor. <br \/>Na tento &uacute;\u010del bol najsk&ocirc;r do\u010dasne uznesen&iacute;m N&aacute;rodnej rady Slovenskej republiky \u010d. 893 z 29. apr&iacute;la 2004 a nesk&ocirc;r na trvalo rokovac&iacute;m poriadkom zriaden&yacute; V&yacute;bor N&aacute;rodnej rady Slovenskej republiky pre eur&oacute;pske z&aacute;le\u017eitosti.<br \/>V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti bol pr&aacute;vnymi predpismi kreovan&yacute; ako siln&yacute; v&yacute;bor. T&aacute;to skuto\u010dnos\u0165 vypl&yacute;va najm&auml; z ustanovenia &uacute;stavn&eacute;ho z&aacute;kona \u010d. 397\/2004 Z. z., pod\u013ea ktor&eacute;ho ak n&aacute;rodn&aacute; rada (v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti) schv&aacute;li n&aacute;vrh stanoviska (mand&aacute;t) vl&aacute;dy, je \u010dlen vl&aacute;dy t&yacute;mto stanoviskom (mand&aacute;tom) viazan&yacute; pri zastupovan&iacute; Slovenskej republiky v pr&iacute;slu&scaron;nom org&aacute;ne E&Uacute;.<br \/>Ke\u010f\u017ee v&scaron;ak v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti v praxi nevykon&aacute;va len p&ocirc;sobnos\u0165 v intenci&aacute;ch &uacute;stavn&eacute;ho z&aacute;kona \u010d. 397\/2004 Z. z. (schva\u013eovanie z&aacute;v&auml;zn&yacute;ch mand&aacute;tov pre \u010dlenov vl&aacute;dy), ale s&uacute; mu rokovac&iacute;m poriadkom zveren&eacute; aj \u010fal&scaron;ie pr&aacute;vomoci n&aacute;rodn&yacute;ch parlamentov (napr. posudzovanie s&uacute;ladu n&aacute;vrhov legislat&iacute;vnych aktov E&Uacute; so z&aacute;sadou subsidiarity vr&aacute;tane schva\u013eovania od&ocirc;vodnen&yacute;ch stanov&iacute;sk), je mo\u017en&eacute; kon&scaron;tatova\u0165, \u017ee slovensk&yacute; model predstavuje tzv. zmie&scaron;an&yacute; syst&eacute;m sledovania z&aacute;le\u017eitost&iacute; E&Uacute; v n&aacute;rodnom parlamente.<br \/>Prerokov&aacute;vanie z&aacute;le\u017eitost&iacute; E&Uacute; vo v&yacute;bore pre eur&oacute;pske z&aacute;le\u017eitosti upravuj&uacute; &sect; 58a a &sect; 58b z&aacute;kona o rokovacom poriadku, v ktor&yacute;ch s&uacute; podrobnej&scaron;ie definovan&eacute; pravidl&aacute; postupu a rokovania tohto v&yacute;boru. Okrem toho vy&scaron;&scaron;ie uveden&eacute; ustanovenia zakotvuj&uacute; zlo\u017eenie v&yacute;boru, sp&ocirc;sob hlasovania, ako aj povinnosti vl&aacute;dy vo\u010di tomuto v&yacute;boru. Nov&yacute; &sect; 58b z&aacute;kona o rokovacom poriadku upravuje postup pri prerokov&aacute;van&iacute; a pod&aacute;van&iacute; \u017ealoby vo veci poru&scaron;enia z&aacute;sady subsidiarity legislat&iacute;vnym aktom E&Uacute;.<br \/>(Vysvetlenie: subsidiarita - to znamen&aacute;, \u017ee \u010do m&ocirc;\u017ee urobi\u0165 ni\u017e&scaron;&iacute; soci&aacute;lny &uacute;tvar s&aacute;m, nem&aacute; ma\u0165 v kompetencii vy&scaron;&scaron;&iacute; soci&aacute;lny &uacute;tvar. Tu to znamen&aacute;, \u017ee \u010do m&ocirc;\u017ee schv&aacute;li\u0165 v&yacute;bor, nemus&iacute; cel&eacute; pl&eacute;num NR SR).<\/p>\r\n<p style=\"text-align: justify;\"><strong>Zlo\u017eenie v&yacute;boru<\/strong><\/p>\r\n<p style=\"text-align: justify;\">N&aacute;rodn&aacute; rada vol&iacute; predsedu a \u010dlenov v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti na z&aacute;klade princ&iacute;pu pomern&eacute;ho zast&uacute;penia politick&yacute;ch str&aacute;n a politick&yacute;ch hnut&iacute;, za ktor&eacute; boli poslanci zvolen&iacute; do n&aacute;rodnej rady v pr&iacute;slu&scaron;nom volebnom obdob&iacute;. Princ&iacute;p pomern&eacute;ho zast&uacute;penia sa uplat\u0148uje z toho d&ocirc;vodu, \u017ee v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti prij&iacute;ma z&aacute;v&auml;zn&eacute; stanovisk&aacute; a odpor&uacute;\u010dania pre z&aacute;stupcov Slovenskej republiky v in&scaron;tit&uacute;ci&aacute;ch E&Uacute;, a preto je potrebn&eacute;, aby o jeho stanovisk&aacute;ch rozhodovali v&scaron;etky politick&eacute; strany a politick&eacute; hnutia zast&uacute;pen&eacute; v n&aacute;rodnej rade.<br \/>V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti je jedin&yacute;m v&yacute;borom n&aacute;rodnej rady, v ktorom m&aacute; ka\u017ed&yacute; z jeho \u010dlenov jedn&eacute;ho n&aacute;hradn&eacute;ho \u010dlena. N&aacute;hradn&yacute;ch \u010dlenov vol&iacute; rovnako n&aacute;rodn&aacute; rada. D&ocirc;vodom je zabezpe\u010denie st&aacute;lej funk\u010dnosti v&yacute;boru <br \/>a \u010do naj&scaron;ir&scaron;ie odborn&eacute; pokrytie agendy v&yacute;boru. N&aacute;hradn&yacute; \u010dlen sa m&ocirc;\u017ee z&uacute;\u010dastni\u0165 na sch&ocirc;dzi v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti za \u010dlena v&yacute;boru na z&aacute;klade ozn&aacute;menia \u010dlena v&yacute;boru predsedovi v&yacute;boru. V tomto pr&iacute;pade sa n&aacute;hradn&yacute; \u010dlen zapo\u010d&iacute;tava do po\u010dtu pr&iacute;tomn&yacute;ch \u010dlenov v&yacute;boru a m&aacute; na sch&ocirc;dzi v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti pr&aacute;vo hlasova\u0165. <br \/>Ak sa z&uacute;\u010dast\u0148uje na sch&ocirc;dzi v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti spolu s \u010dlenom v&yacute;boru, ktor&eacute;ho je n&aacute;hradn&yacute;m \u010dlenom, alebo bez ozn&aacute;menia \u010dlena v&yacute;boru o &uacute;\u010dasti n&aacute;hradn&eacute;ho \u010dlena, n&aacute;hradn&yacute; \u010dlen sa nezapo\u010d&iacute;tava do po\u010dtu pr&iacute;tomn&yacute;ch \u010dlenov v&yacute;boru a nem&aacute; pr&aacute;vo hlasova\u0165. N&aacute;hradn&yacute; \u010dlen za predsedu v&yacute;boru alebo podpredsedu v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti sa na sch&ocirc;dzi v&yacute;boru z&uacute;\u010dast\u0148uje ako \u010dlen v&yacute;boru (8).<br \/>Na rokovan&iacute; v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti sa m&ocirc;\u017eu z&uacute;\u010dast\u0148ova\u0165 aj poslanci Eur&oacute;pskeho parlamentu zvolen&iacute; na &uacute;zem&iacute; Slovenskej republiky, pri\u010dom maj&uacute; pr&aacute;vo vyjadrova\u0165 sa k prerok&uacute;vanej veci, ak po\u017eiadaj&uacute; o slovo. Na rokovan&iacute; v&scaron;ak nemaj&uacute; pr&aacute;vo hlasova\u0165.<\/p>\r\n<p style=\"text-align: justify;\"><strong>P&ocirc;sobnos\u0165 v&yacute;boru<\/strong><\/p>\r\n<p style=\"text-align: justify;\">V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti:<br \/>a) prerok&uacute;va n&aacute;vrhy pr&aacute;vne z&aacute;v&auml;zn&yacute;ch aktov a in&yacute;ch aktov Eur&oacute;pskej &uacute;nie,<br \/>b) schva\u013euje stanovisk&aacute; Slovenskej republiky k n&aacute;vrhom pod\u013ea p&iacute;smena a), o ktor&yacute;ch bud&uacute; rokova\u0165 pr&iacute;slu&scaron;n&eacute; org&aacute;ny Eur&oacute;pskej &uacute;nie,<br \/>c) posudzuje s&uacute;lad n&aacute;vrhov legislat&iacute;vnych aktov Eur&oacute;pskej &uacute;nie so z&aacute;sadou subsidiarity vr&aacute;tane schva\u013eovania od&ocirc;vodnen&yacute;ch stanov&iacute;sk,<br \/>d) prerok&uacute;va n&aacute;vrhy \u017eal&ocirc;b vo veci poru&scaron;enia z&aacute;sady subsidiarity legislat&iacute;vnym aktom Eur&oacute;pskej &uacute;nie,<br \/>e) prerok&uacute;va spr&aacute;vy a inform&aacute;cie predkladan&eacute; n&aacute;rodnej rade vl&aacute;dou a \u010dlenmi vl&aacute;dy a akty predkladan&eacute; n&aacute;rodnej rade org&aacute;nmi Eur&oacute;pskej &uacute;nie,<br \/>f) m&ocirc;\u017ee po\u017eiada\u0165 ostatn&eacute; v&yacute;bory n&aacute;rodnej rady o ich stanovisk&aacute; k n&aacute;vrhom pod\u013ea p&iacute;smen a) a b),<br \/>g) pod&aacute;va n&aacute;rodnej rade spr&aacute;vy o \u010dinnosti pod\u013ea p&iacute;smen a) a\u017e f) (9).<br \/>N&aacute;rodn&aacute; rada si v&scaron;ak m&ocirc;\u017ee vyhradi\u0165 rozhodnutie o z&aacute;le\u017eitostiach pod\u013ea p&iacute;sm. a) a\u017e c). <br \/>T&yacute;mto sa ponech&aacute;va n&aacute;rodnej rade mo\u017enos\u0165, aby si v pr&iacute;padoch osobitnej d&ocirc;le\u017eitosti vyhradila rozhodnutie vo veciach zveren&yacute;ch do p&ocirc;sobnosti v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti.<br \/>Z vy&scaron;&scaron;ie uveden&eacute;ho je zrejm&eacute;, \u017ee v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti m&ocirc;\u017ee po\u017eiada\u0165 aj ostatn&eacute; v&yacute;bory n&aacute;rodnej rady (tzv. vecn&eacute; v&yacute;bory) o stanovisk&aacute; k n&aacute;vrhom pr&aacute;vne z&aacute;v&auml;zn&yacute;ch aktov a in&yacute;ch aktov E&Uacute; a k n&aacute;vrhom stanov&iacute;sk Slovenskej republiky k t&yacute;mto n&aacute;vrhom. <br \/>Spolupr&aacute;ca v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti s vecn&yacute;mi v&yacute;bormi vo veciach podstaty n&aacute;vrhov pr&aacute;vnych aktov E&Uacute; a n&aacute;vrhov stanov&iacute;sk Slovenskej republiky k nim je be\u017enou praxou a umo\u017e\u0148uje zoh\u013eadni\u0165 &scaron;ir&scaron;ie spektrum odborn&yacute;ch a politick&yacute;ch n&aacute;zorov. <br \/>O stanovisko vecn&eacute;ho v&yacute;boru v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti po\u017eiada spravidla vtedy, ak gestorsk&eacute; ministerstvo ozna\u010d&iacute; n&aacute;vrh ako prioritn&yacute; (s vysokou d&ocirc;le\u017eitos\u0165ou) z poh\u013eadu z&aacute;ujmov Slovenskej republiky. <br \/>Napr&iacute;klad ak sa n&aacute;vrh pr&aacute;vne z&aacute;v&auml;zn&eacute;ho aktu E&Uacute; prioritnej d&ocirc;le\u017eitosti t&yacute;ka problematiky financi&iacute;, m&ocirc;\u017ee v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti po\u017eiada\u0165 o odborn&eacute; stanovisko k podstate toho n&aacute;vrhu V&yacute;bor NR SR pre financie a rozpo\u010det a pod. <br \/>V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti potom pri \u010fal&scaron;om rokovan&iacute; o n&aacute;vrhu zoh\u013eadn&iacute; stanovisko vecn&eacute;ho v&yacute;boru k tomuto n&aacute;vrhu, ak bolo v&yacute;boru doru\u010den&eacute;.<br \/>Rokovac&iacute; poriadok neustanovuje, v ktorom &scaron;t&aacute;diu rozhodovac&iacute;ch procesov na &uacute;rovni E&Uacute; sa m&aacute; n&aacute;rodn&aacute; rada (resp. v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti) uveden&yacute;mi n&aacute;vrhmi zaobera\u0165, ponech&aacute;vaj&uacute;c tak aj toto na rozhodnut&iacute; samotnej n&aacute;rodnej rady resp. v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti. <br \/>Predseda v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti priebe\u017ene zarad&iacute; do n&aacute;vrhu programu sch&ocirc;dze n&aacute;vrhy pr&aacute;vnych aktov E&Uacute;, ktor&eacute; boli v&yacute;boru doru\u010den&eacute;, spravidla tak, aby v&yacute;bor mohol v pr&iacute;pade n&aacute;vrhov legislat&iacute;vnych aktov presk&uacute;ma\u0165 ich s&uacute;lad so z&aacute;sadou subsidiarity do &ocirc;smich t&yacute;\u017ed\u0148ov od ich doru\u010denia. <br \/>V praxi to znamen&aacute;, \u017ee v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti je pravidelne informovan&yacute; o nov&yacute;ch n&aacute;vrhoch pr&aacute;vnych aktov E&Uacute; formou tabu\u013eky s nov&yacute;mi n&aacute;vrhmi. Tabu\u013eka obsahuje inform&aacute;ciu o stru\u010dnom obsahu n&aacute;vrhu, kedy kon\u010d&iacute; lehota na pos&uacute;denie s&uacute;ladu so z&aacute;sadou subsidiarity, inform&aacute;ciu o d&ocirc;le\u017eitosti n&aacute;vrhu z poh\u013eadu z&aacute;ujmov Slovenskej republiky a odpor&uacute;\u010danie Odboru pre eur&oacute;pske z&aacute;le\u017eitosti kancel&aacute;rie n&aacute;rodnej rady, \u010di sa m&aacute; v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti n&aacute;vrhom \u010falej zaobera\u0165 a akou formou.<br \/>Ako bolo vysvetlen&eacute; vy&scaron;&scaron;ie, Lisabonsk&aacute; zmluva zav&aacute;dza pr&aacute;vo n&aacute;rodn&yacute;ch parlamentov dohliada\u0165 prostredn&iacute;ctvom syst&eacute;mu v\u010dasn&eacute;ho varovania nad dodr\u017eiavan&iacute;m z&aacute;sady subsidiarity v n&aacute;vrhoch legislat&iacute;vnych aktov E&Uacute;. <br \/>Ke\u010f\u017ee n&aacute;rodn&aacute; rada zverila svoje pr&aacute;vomoci v oblasti eur&oacute;pskych z&aacute;le\u017eitost&iacute; v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti, pr&aacute;ve tento v&yacute;bor m&aacute; mo\u017enos\u0165 kontrolova\u0165 s&uacute;lad spom&iacute;nan&yacute;ch n&aacute;vrhov pr&aacute;vnych aktov E&Uacute; z h\u013eadiska ich s&uacute;ladu so z&aacute;sadou subsidiarity. <br \/>Ak sa n&aacute;rodn&aacute; rada (v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti) v osemt&yacute;\u017ed\u0148ovej lehote stanovenej Lisabonskou zmluvou uznesie na tom, \u017ee konkr&eacute;tny n&aacute;vrh legislat&iacute;vneho aktu E&Uacute; nie je v s&uacute;lade so z&aacute;sadou subsidiarity, za&scaron;le pr&iacute;slu&scaron;n&yacute;m in&scaron;tit&uacute;ci&aacute;m E&Uacute; od&ocirc;vodnen&eacute; stanovisko uv&aacute;dzaj&uacute;ce, pre\u010do sa domnieva, \u017ee dan&yacute; n&aacute;vrh nie je <br \/>v s&uacute;lade so z&aacute;sadou subsidiarity. Ak predlo\u017een&eacute; od&ocirc;vodnen&eacute; stanovisk&aacute; zodpovedaj&uacute; potrebnej v&auml;\u010d&scaron;ine hlasov priraden&yacute;ch n&aacute;rodn&yacute;m parlamentom, uplatn&iacute; sa mechanizmus \u017eltej alebo oran\u017eovej karty pop&iacute;san&yacute; v prvej \u010dasti tejto kapitoly.<br \/>Okrem uveden&yacute;ch blokuj&uacute;cich prostriedkov m&ocirc;\u017eu n&aacute;rodn&eacute; parlamenty iniciova\u0165 s&uacute;dnu kontrolu dodr\u017eiavania z&aacute;sady subsidiarity, a to podan&iacute;m n&aacute;vrhu na S&uacute;dny dvor E&Uacute; na za\u010datie osobitn&eacute;ho typu konania o neplatnosti legislat&iacute;vneho aktu. <br \/>V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti alebo najmenej p&auml;tina poslancov n&aacute;rodnej rady m&ocirc;\u017ee p&iacute;somne po\u017eiada\u0165 n&aacute;rodn&uacute; radu, aby sa uzniesla na podan&iacute; \u017ealoby vo veci poru&scaron;enia z&aacute;sady subsidiarity legislat&iacute;vnym aktom E&Uacute;. <br \/>N&aacute;vrh \u017ealoby mus&iacute; obsahova\u0165 presn&eacute; znenie \u017ealoby, na ktorej sa m&aacute; n&aacute;rodn&aacute; rada uznies\u0165. N&aacute;vrh \u017ealoby sa predklad&aacute; predsedovi n&aacute;rodnej rady, a to najnesk&ocirc;r p&auml;tn&aacute;sty de\u0148 pred uplynut&iacute;m lehoty na podanie \u017ealoby, pri\u010dom \u010fal&scaron;ie n&aacute;le\u017eitosti bli\u017e&scaron;ie upravuje &sect; 58b z&aacute;kona o rokovacom poriadku.<\/p>\r\n<p style=\"text-align: justify;\"><strong>Predbe\u017en&eacute; stanovisko<\/strong><\/p>\r\n<p style=\"text-align: justify;\">Cie\u013eom predbe\u017en&eacute;ho stanoviska je na &uacute;vod legislat&iacute;vneho procesu na &uacute;rovni E&Uacute; definova\u0165 v&yacute;chodiskov&eacute; poz&iacute;cie Slovenskej republiky a ur\u010di\u0165 n&aacute;rodn&eacute; priority pre nasleduj&uacute;cu diskusiu. <br \/>Predbe\u017en&eacute; stanovisko je v&yacute;chodiskov&yacute;m dokumentom pre z&aacute;stupcu Slovenskej republiky v diskusi&aacute;ch v pracovn&yacute;ch skupin&aacute;ch Rady. Pripravuje ho zodpovedaj&uacute;ci &uacute;stredn&yacute; org&aacute;n &scaron;t&aacute;tnej spr&aacute;vy a schva\u013euje pr&iacute;slu&scaron;n&aacute; Rezortn&aacute; koordina\u010dn&aacute; skupina (t.j. expertn&aacute; skupina, ktor&aacute; koordinuje rozhodovac&iacute; proces v z&aacute;le\u017eitostiach E&Uacute; na &uacute;rovni ministerstva alebo in&eacute;ho &uacute;stredn&eacute;ho org&aacute;nu &scaron;t&aacute;tnej spr&aacute;vy). Vl&aacute;da alebo poveren&yacute; \u010dlen vl&aacute;dy najnesk&ocirc;r &scaron;tyri t&yacute;\u017edne po obdr\u017ean&iacute; n&aacute;vrhu pr&aacute;vneho aktu a n&aacute;vrhu legislat&iacute;vneho aktu E&Uacute; predklad&aacute; v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti predbe\u017en&eacute; stanovisko k tomuto n&aacute;vrhu. Predbe\u017en&eacute; stanovisko je pozi\u010dn&yacute;m dokumentom vl&aacute;dy (ministerstva), ktor&yacute; obsahuje prim&aacute;rne hodnotenie predlo\u017een&eacute;ho n&aacute;vrhu v po\u010diato\u010dnom &scaron;t&aacute;diu legislat&iacute;vneho procesu na &uacute;rovni E&Uacute;.<br \/><br \/>V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti sa m&ocirc;\u017ee s hodnoten&iacute;m s&uacute;ladu n&aacute;vrhu so z&aacute;sadou subsidiarity v predbe\u017enom stanovisku stoto\u017eni\u0165 a s predlo\u017een&yacute;m predbe\u017en&yacute;m stanoviskom vyslovi\u0165 s&uacute;hlas, alebo v opa\u010dnom pr&iacute;pade, m&ocirc;\u017ee \u010dlena vl&aacute;dy zaviaza\u0165 presadzova\u0165 v Rade in&uacute; poz&iacute;ciu (napr. namieta\u0165 poru&scaron;enie z&aacute;sady subsidiarity).<\/p>\r\n<p style=\"text-align: justify;\"><strong>Stanovisko Slovenskej republiky<\/strong><\/p>\r\n<p style=\"text-align: justify;\">Stanovisko Slovenskej republiky predstavuje n&aacute;rodn&eacute; stanovisko na diskusiu alebo rozhodnutie na zasadnutia Rady. N&aacute;vrh stanoviska Slovenskej republiky na rokovanie Rady pripravuje gestorsk&yacute; rezort na z&aacute;klade dovtedy spracovan&yacute;ch materi&aacute;lov (predbe\u017en&eacute; stanovisko, poz&iacute;cia a in&scaron;trukcia) a na z&aacute;klade v&yacute;sledkov rokovan&iacute; pr&iacute;slu&scaron;n&yacute;ch Pracovn&yacute;ch skup&iacute;n Rady, v&yacute;borov Rady a V&yacute;boru st&aacute;lych z&aacute;stupcov (tzv. COREPER). N&aacute;vrh stanoviska schva\u013euje zodpovedn&yacute; minister alebo ved&uacute;ci predstavite\u013e in&eacute;ho &uacute;stredn&eacute;ho org&aacute;nu &scaron;t&aacute;tnej spr&aacute;vy, pri\u010dom pred schv&aacute;len&iacute;m je n&aacute;vrh predmetom rokovania Komisie pre eur&oacute;pske z&aacute;le\u017eitosti, ktor&aacute; p&ocirc;sob&iacute; na Ministerstve zahrani\u010dn&yacute;ch vec&iacute; a eur&oacute;pskych z&aacute;le\u017eitost&iacute; SR a je hlavn&yacute;m expertn&yacute;m medzirezortn&yacute;m koordina\u010dn&yacute;m org&aacute;nom v oblasti tvorby stanov&iacute;sk k n&aacute;vrhom pr&aacute;vnych aktov E&Uacute;.<br \/>Vl&aacute;da alebo poveren&yacute; \u010dlen vl&aacute;dy v dostato\u010dnom \u010dasovom predstihu predklad&aacute; v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti n&aacute;vrh stanoviska Slovenskej republiky k n&aacute;vrhom pr&aacute;vne z&aacute;v&auml;zn&yacute;ch aktov a in&yacute;ch aktov E&Uacute;, pri\u010dom v tejto veci je povinn&yacute; <br \/>z&uacute;\u010dastni\u0165 sa na rokovan&iacute; v&yacute;boru a informova\u0165 ho (10).<br \/>Ak v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti schv&aacute;li n&aacute;vrh stanoviska Slovenskej republiky, je \u010dlen vl&aacute;dy t&yacute;mto stanoviskom viazan&yacute; pri zastupovan&iacute; Slovenskej republiky v pr&iacute;slu&scaron;nom org&aacute;ne E&Uacute;. <br \/>\u010clen vl&aacute;dy sa m&ocirc;\u017ee od stanoviska Slovenskej republiky odch&yacute;li\u0165 len v nevyhnutnom pr&iacute;pade a so zrete\u013eom na z&aacute;ujmy Slovenskej republiky; v takom pr&iacute;pade je povinn&yacute; o tom bezodkladne informova\u0165 v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti a tak&yacute;to postup od&ocirc;vodni\u0165. <br \/>\u010clen vl&aacute;dy m&ocirc;\u017ee po\u017eiada\u0165 v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti o zmenu stanoviska Slovenskej republiky (11). Ak sa v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti nevyjadr&iacute; k n&aacute;vrhu stanoviska Slovenskej republiky do dvoch t&yacute;\u017ed\u0148ov od jeho predlo\u017eenia, \u010dlen vl&aacute;dy je viazan&yacute; (predlo\u017een&yacute;m) n&aacute;vrhom stanoviska Slovenskej republiky (12). Mo\u017enos\u0165 sa ku n&aacute;vrhu stanoviska nevyjadri\u0165 (tzv. princ&iacute;p tichej proced&uacute;ry) je prejavom mo\u017enosti stanovisko vzia\u0165 na vedomie resp. &bdquo;ml\u010dky&ldquo; <br \/>ods&uacute;hlasi\u0165 a v&ocirc;bec ho neprerokov&aacute;va\u0165 ani explicitne neschva\u013eova\u0165.<br \/>Ak v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti neschv&aacute;li n&aacute;vrh stanoviska Slovenskej republiky a z&aacute;rove\u0148 neschv&aacute;li v danej veci in&eacute; stanovisko, \u010dlen vl&aacute;dy je viazan&yacute; (p&ocirc;vodn&yacute;m) n&aacute;vrhom stanoviska Slovenskej republiky (13). Tento princ&iacute;p je analogick&yacute; k tzv. princ&iacute;pu kon&scaron;trukt&iacute;vneho nes&uacute;hlasu.<\/p>\r\n<p style=\"text-align: justify;\"><strong>Spr&aacute;va o z&aacute;le\u017eitostiach s&uacute;visiacich s \u010dlenstvom Slovenskej republiky v E&Uacute;<\/strong><\/p>\r\n<p style=\"text-align: justify;\">Vl&aacute;da zabezpe\u010d&iacute; pravideln&eacute; informovanie v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti \u010dlenmi vl&aacute;dy o aktu&aacute;lnych ot&aacute;zkach, ktor&eacute; s&uacute; prerok&uacute;van&eacute; v org&aacute;noch E&Uacute;, ktor&yacute;ch s&uacute; \u010dlenmi. Vl&aacute;da predklad&aacute; n&aacute;rodnej rade do konca marca spr&aacute;vu o z&aacute;le\u017eitostiach s&uacute;visiacich s \u010dlenstvom Slovenskej republiky v E&Uacute; za predch&aacute;dzaj&uacute;ci kalend&aacute;rny rok, ak n&aacute;rodn&aacute; rada nerozhodne inak.<br \/>V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti m&ocirc;\u017ee kedyko\u013evek po\u017eiada\u0165 vl&aacute;du alebo poveren&eacute;ho \u010dlena vl&aacute;dy o predlo\u017eenie spr&aacute;vy, podanie inform&aacute;cie, od&ocirc;vodnenia alebo vysvetlenia v z&aacute;le\u017eitostiach s&uacute;visiacich s \u010dlenstvom Slovenskej republiky v Eur&oacute;pskej &uacute;nii (14).<\/p>\r\n<p style=\"text-align: justify;\"><strong>Odbor pre eur&oacute;pske z&aacute;le\u017eitosti<\/strong><\/p>\r\n<p style=\"text-align: justify;\">Na zabezpe\u010denie v&yacute;konu p&ocirc;sobnosti n&aacute;rodnej rady v z&aacute;le\u017eitostiach E&Uacute; zriadila kancel&aacute;ria n&aacute;rodnej rady Odbor pre eur&oacute;pske z&aacute;le\u017eitosti, ktor&eacute;ho pracovn&iacute;ci pripravuj&uacute; odborn&eacute; podkladov&eacute; materi&aacute;ly na rokovanie v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti.<br \/><br \/>Dopl\u0148uj&uacute;ce inform&aacute;cie:<br \/>(1) Vl&aacute;da Slovenskej republiky. Ide o r&aacute;mcov&uacute; &uacute;pravu vz\u0165ahov z&aacute;konodarnej a v&yacute;konnej zlo\u017eky moci v oblasti z&aacute;le\u017eitost&iacute; E&Uacute;. Tento &uacute;stavn&yacute; z&aacute;kon dosia\u013e nebol zmenen&yacute; ani doplnen&yacute;, a tak niektor&eacute; jeho ustanovenia nezodpovedaj&uacute; terminol&oacute;gii Lisabonskej zmluvy, \u010do v&scaron;ak nem&aacute; vplyv na re&aacute;lne postavenie n&aacute;rodnej rady v z&aacute;le\u017eitostiach E&Uacute;.<\/p>\r\n<p style=\"text-align: justify;\"><strong>Vz\u0165ah n&aacute;rodnej rady a vl&aacute;dy v z&aacute;le\u017eitostiach E&Uacute; <\/strong>m&aacute; v z&aacute;sade dve roviny - povinnos\u0165 vl&aacute;dy predklada\u0165 ur\u010den&eacute; materi&aacute;ly a pr&aacute;vomoc n&aacute;rodnej rady schva\u013eova\u0165 stanovisk&aacute; Slovenskej republiky. <br \/>Vl&aacute;da alebo poveren&yacute; \u010dlen vl&aacute;dy predklad&aacute; n&aacute;rodnej rade n&aacute;vrhy pr&aacute;vne z&aacute;v&auml;zn&yacute;ch aktov a in&yacute;ch aktov E&Uacute;, o ktor&yacute;ch bud&uacute; rokova\u0165 z&aacute;stupcovia vl&aacute;d \u010dlensk&yacute;ch &scaron;t&aacute;tov E&Uacute;, a informuje n&aacute;rodn&uacute; radu o ostatn&yacute;ch z&aacute;le\u017eitostiach s&uacute;visiacich s \u010dlenstvom Slovenskej republiky v E&Uacute;. <br \/>Tieto n&aacute;vrhy m&aacute; n&aacute;rodn&aacute; rada k dispoz&iacute;cii nielen od vl&aacute;dy, ale s&uacute; v r&aacute;mci tzv. Barrosovej iniciat&iacute;vy zasielan&eacute; aj priamo n&aacute;rodn&yacute;m parlamentom (2). Okrem toho vl&aacute;da predklad&aacute; n&aacute;rodnej rade aj n&aacute;vrhy stanov&iacute;sk Slovenskej republiky k n&aacute;vrhom pr&aacute;vne z&aacute;v&auml;zn&yacute;ch aktov a in&yacute;ch aktov E&Uacute;, pri\u010dom ich s&uacute;\u010das\u0165ou je najm&auml; odhad ich vplyvu a dosahu na Slovensk&uacute; republiku (3).<br \/>N&aacute;rodn&aacute; rada m&aacute; pr&aacute;vomoc (mo\u017enos\u0165) schva\u013eova\u0165 stanovisk&aacute; Slovenskej republiky k n&aacute;vrhom pr&aacute;vne z&aacute;v&auml;zn&yacute;ch aktov a in&yacute;ch aktov E&Uacute;, o ktor&yacute;ch sa rozhoduje na &uacute;rovni z&aacute;stupcov vl&aacute;d \u010dlensk&yacute;ch &scaron;t&aacute;tov E&Uacute;. <br \/>Z tejto pr&aacute;vnej &uacute;pravy vypl&yacute;va teda pr&aacute;vo n&aacute;rodnej rady, nie v&scaron;ak povinnos\u0165, vyjadrova\u0165 sa k stanovisk&aacute;m vl&aacute;dy k n&aacute;vrhom pr&aacute;vnych aktov E&Uacute;. <br \/>N&aacute;rodn&aacute; rada m&ocirc;\u017ee (ale nemus&iacute;) schva\u013eova\u0165 stanovisk&aacute; Slovenskej republiky aj k \u010fal&scaron;&iacute;m z&aacute;le\u017eitostiam E&Uacute;, ak ju o to po\u017eiada vl&aacute;da alebo najmenej p&auml;tina poslancov n&aacute;rodnej rady. <br \/>Aj v tomto pr&iacute;pade ide o pr&aacute;vo n&aacute;rodnej rady, ale nie o povinnos\u0165 vyjadrova\u0165 sa aj k in&yacute;m z&aacute;le\u017eitostiam E&Uacute;. &Uacute;stavn&yacute; z&aacute;kon \u010d. 397\/2004 Z. z. stanovuje pr&aacute;vne &uacute;\u010dinky pre pr&iacute;pady, ke\u010f n&aacute;rodn&aacute; rada:<br \/>- schv&aacute;li n&aacute;vrh stanoviska Slovenskej republiky;<br \/>- nevyjadr&iacute; sa k n&aacute;vrhu stanoviska Slovenskej republiky<br \/>v lehote dvoch t&yacute;\u017ed\u0148ov od jeho predlo\u017eenia;<br \/>- neschv&aacute;li n&aacute;vrh stanoviska Slovenskej republiky ani in&eacute; stanovisko v tej istej veci.<\/p>\r\n<p style=\"text-align: justify;\">Ak n&aacute;rodn&aacute; rada schv&aacute;li n&aacute;vrh stanoviska Slovenskej republiky, \u010dlen vl&aacute;dy je t&yacute;mto stanoviskom viazan&yacute; pri zastupovan&iacute; Slovenskej republiky v pr&iacute;slu&scaron;nom org&aacute;ne E&Uacute;. \u010clen vl&aacute;dy sa m&ocirc;\u017ee od stanoviska Slovenskej republiky odch&yacute;li\u0165 len v nevyhnutnom pr&iacute;pade a so zrete\u013eom na z&aacute;ujmy Slovenskej republiky; v takom pr&iacute;pade je povinn&yacute; o tom bezodkladne informova\u0165 n&aacute;rodn&uacute; radu a tak&yacute;to postup od&ocirc;vodni\u0165. <br \/>\u010clen vl&aacute;dy m&ocirc;\u017ee po\u017eiada\u0165 n&aacute;rodn&uacute; radu o zmenu stanoviska Slovenskej republiky (4).<br \/>Ak sa n&aacute;rodn&aacute; rada nevyjadr&iacute; k n&aacute;vrhu stanoviska Slovenskej republiky do dvoch t&yacute;\u017ed\u0148ov od jeho predlo\u017eenia, \u010dlen vl&aacute;dy je viazan&yacute; (predlo\u017een&yacute;m) n&aacute;vrhom stanoviska Slovenskej republiky (5). <br \/>Mo\u017enos\u0165 sa ku n&aacute;vrhu stanoviska nevyjadri\u0165 (tzv. princ&iacute;p tichej proced&uacute;ry) je prejavom mo\u017enosti stanovisko vzia\u0165 na vedomie resp. &bdquo;ml\u010dky&ldquo; ods&uacute;hlasi\u0165 a v&ocirc;bec ho neprerokov&aacute;va\u0165 ani explicitne neschva\u013eova\u0165. <br \/>Ak sa n&aacute;rodn&aacute; rada rozhodne nevyjadri\u0165 sa, vl&aacute;da bude v org&aacute;noch E&Uacute; prezentova\u0165 tak&eacute; stanovisko, ktor&eacute; si k danej veci pripravila a predlo\u017eila n&aacute;rodnej rade. <br \/>T&aacute;to mo\u017enos\u0165 m&aacute; vyu\u017eitie napr&iacute;klad pri margin&aacute;lnych ot&aacute;zkach, pri ktor&yacute;ch by prerokov&aacute;vanie a schva\u013eovanie bolo len nadbyto\u010dn&yacute;m procedur&aacute;lnym za\u0165a\u017een&iacute;m n&aacute;rodnej rady na &uacute;kor rozsiahlej&scaron;&iacute;ch ot&aacute;zok so &scaron;ir&scaron;&iacute;m nadn&aacute;rodno-politick&yacute;m dosahom.<br \/>Ak n&aacute;rodn&aacute; rada neschv&aacute;li n&aacute;vrh stanoviska Slovenskej republiky a z&aacute;rove\u0148 neschv&aacute;li v danej veci in&eacute; stanovisko, \u010dlen vl&aacute;dy je viazan&yacute; (predlo\u017een&yacute;m) &aacute;vrhom stanoviska Slovenskej republiky (6). <br \/>Tento princ&iacute;p je analogick&yacute; k tzv. princ&iacute;pu kon&scaron;trukt&iacute;vneho nes&uacute;hlasu.<br \/>Okrem toho n&aacute;rodn&aacute; rada najmenej raz za rok na z&aacute;klade spr&aacute;vy podanej vl&aacute;dou rokuje o z&aacute;le\u017eitostiach s&uacute;visiacich s \u010dlenstvom Slovenskej republiky v E&Uacute; a schva\u013euje odpor&uacute;\u010dania pre vl&aacute;du v nasleduj&uacute;com obdob&iacute; (7).<\/p>\r\n<p style=\"text-align: justify;\"><strong>V&yacute;bor N&aacute;rodnej rady Slovenskej republiky pre eur&oacute;pske z&aacute;le\u017eitosti<\/strong><\/p>\r\n<p style=\"text-align: justify;\">Pod\u013ea &uacute;stavn&eacute;ho z&aacute;kona \u010d. 397\/2004 Z. z. m&ocirc;\u017ee n&aacute;rodn&aacute; rada vykon&aacute;van&iacute;m p&ocirc;sobnosti v z&aacute;le\u017eitostiach E&Uacute; z&aacute;konom poveri\u0165 svoj v&yacute;bor. To znamen&aacute;, \u017ee pokia\u013e sa n&aacute;rodn&aacute; rada uznesie, \u017ee v&scaron;etka eur&oacute;pska agenda, ktorou sa rozhodne zaobera\u0165, nebude prerokov&aacute;van&aacute; na sch&ocirc;dzi n&aacute;rodnej rady, m&ocirc;\u017ee na tento &uacute;\u010del zriadi\u0165 nov&yacute; v&yacute;bor alebo poveri\u0165 touto p&ocirc;sobnos\u0165ou in&yacute;, u\u017e existuj&uacute;ci v&yacute;bor. <br \/>Na tento &uacute;\u010del bol najsk&ocirc;r do\u010dasne uznesen&iacute;m N&aacute;rodnej rady Slovenskej republiky \u010d. 893 z 29. apr&iacute;la 2004 a nesk&ocirc;r na trvalo rokovac&iacute;m poriadkom zriaden&yacute; V&yacute;bor N&aacute;rodnej rady Slovenskej republiky pre eur&oacute;pske z&aacute;le\u017eitosti.<br \/>V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti bol pr&aacute;vnymi predpismi kreovan&yacute; ako siln&yacute; v&yacute;bor. T&aacute;to skuto\u010dnos\u0165 vypl&yacute;va najm&auml; z ustanovenia &uacute;stavn&eacute;ho z&aacute;kona \u010d. 397\/2004 Z. z., pod\u013ea ktor&eacute;ho ak n&aacute;rodn&aacute; rada (v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti) schv&aacute;li n&aacute;vrh stanoviska (mand&aacute;t) vl&aacute;dy, je \u010dlen vl&aacute;dy t&yacute;mto stanoviskom (mand&aacute;tom) viazan&yacute; pri zastupovan&iacute; Slovenskej republiky v pr&iacute;slu&scaron;nom org&aacute;ne E&Uacute;.<br \/>Ke\u010f\u017ee v&scaron;ak v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti v praxi nevykon&aacute;va len p&ocirc;sobnos\u0165 v intenci&aacute;ch &uacute;stavn&eacute;ho z&aacute;kona \u010d. 397\/2004 Z. z. (schva\u013eovanie z&aacute;v&auml;zn&yacute;ch mand&aacute;tov pre \u010dlenov vl&aacute;dy), ale s&uacute; mu rokovac&iacute;m poriadkom zveren&eacute; aj \u010fal&scaron;ie pr&aacute;vomoci n&aacute;rodn&yacute;ch parlamentov (napr. posudzovanie s&uacute;ladu n&aacute;vrhov legislat&iacute;vnych aktov E&Uacute; so z&aacute;sadou subsidiarity vr&aacute;tane schva\u013eovania od&ocirc;vodnen&yacute;ch stanov&iacute;sk), je mo\u017en&eacute; kon&scaron;tatova\u0165, \u017ee slovensk&yacute; model predstavuje tzv. zmie&scaron;an&yacute; syst&eacute;m sledovania z&aacute;le\u017eitost&iacute; E&Uacute; v n&aacute;rodnom parlamente.<br \/>Prerokov&aacute;vanie z&aacute;le\u017eitost&iacute; E&Uacute; vo v&yacute;bore pre eur&oacute;pske z&aacute;le\u017eitosti upravuj&uacute; &sect; 58a a &sect; 58b z&aacute;kona o rokovacom poriadku, v ktor&yacute;ch s&uacute; podrobnej&scaron;ie definovan&eacute; pravidl&aacute; postupu a rokovania tohto v&yacute;boru. Okrem toho vy&scaron;&scaron;ie uveden&eacute; ustanovenia zakotvuj&uacute; zlo\u017eenie v&yacute;boru, sp&ocirc;sob hlasovania, ako aj povinnosti vl&aacute;dy vo\u010di tomuto v&yacute;boru. Nov&yacute; &sect; 58b z&aacute;kona o rokovacom poriadku upravuje postup pri prerokov&aacute;van&iacute; a pod&aacute;van&iacute; \u017ealoby vo veci poru&scaron;enia z&aacute;sady subsidiarity legislat&iacute;vnym aktom E&Uacute;.<br \/>(Vysvetlenie: subsidiarita - to znamen&aacute;, \u017ee \u010do m&ocirc;\u017ee urobi\u0165 ni\u017e&scaron;&iacute; soci&aacute;lny &uacute;tvar s&aacute;m, nem&aacute; ma\u0165 v kompetencii vy&scaron;&scaron;&iacute; soci&aacute;lny &uacute;tvar. Tu to znamen&aacute;, \u017ee \u010do m&ocirc;\u017ee schv&aacute;li\u0165 v&yacute;bor, nemus&iacute; cel&eacute; pl&eacute;num NR SR).<\/p>\r\n<p style=\"text-align: justify;\"><strong>Zlo\u017eenie v&yacute;boru<\/strong><\/p>\r\n<p style=\"text-align: justify;\">N&aacute;rodn&aacute; rada vol&iacute; predsedu a \u010dlenov v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti na z&aacute;klade princ&iacute;pu pomern&eacute;ho zast&uacute;penia politick&yacute;ch str&aacute;n a politick&yacute;ch hnut&iacute;, za ktor&eacute; boli poslanci zvolen&iacute; do n&aacute;rodnej rady v pr&iacute;slu&scaron;nom volebnom obdob&iacute;. Princ&iacute;p pomern&eacute;ho zast&uacute;penia sa uplat\u0148uje z toho d&ocirc;vodu, \u017ee v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti prij&iacute;ma z&aacute;v&auml;zn&eacute; stanovisk&aacute; a odpor&uacute;\u010dania pre z&aacute;stupcov Slovenskej republiky v in&scaron;tit&uacute;ci&aacute;ch E&Uacute;, a preto je potrebn&eacute;, aby o jeho stanovisk&aacute;ch rozhodovali v&scaron;etky politick&eacute; strany a politick&eacute; hnutia zast&uacute;pen&eacute; v n&aacute;rodnej rade.<br \/>V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti je jedin&yacute;m v&yacute;borom n&aacute;rodnej rady, v ktorom m&aacute; ka\u017ed&yacute; z jeho \u010dlenov jedn&eacute;ho n&aacute;hradn&eacute;ho \u010dlena. N&aacute;hradn&yacute;ch \u010dlenov vol&iacute; rovnako n&aacute;rodn&aacute; rada. D&ocirc;vodom je zabezpe\u010denie st&aacute;lej funk\u010dnosti v&yacute;boru <br \/>a \u010do naj&scaron;ir&scaron;ie odborn&eacute; pokrytie agendy v&yacute;boru. N&aacute;hradn&yacute; \u010dlen sa m&ocirc;\u017ee z&uacute;\u010dastni\u0165 na sch&ocirc;dzi v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti za \u010dlena v&yacute;boru na z&aacute;klade ozn&aacute;menia \u010dlena v&yacute;boru predsedovi v&yacute;boru. V tomto pr&iacute;pade sa n&aacute;hradn&yacute; \u010dlen zapo\u010d&iacute;tava do po\u010dtu pr&iacute;tomn&yacute;ch \u010dlenov v&yacute;boru a m&aacute; na sch&ocirc;dzi v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti pr&aacute;vo hlasova\u0165. <br \/>Ak sa z&uacute;\u010dast\u0148uje na sch&ocirc;dzi v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti spolu s \u010dlenom v&yacute;boru, ktor&eacute;ho je n&aacute;hradn&yacute;m \u010dlenom, alebo bez ozn&aacute;menia \u010dlena v&yacute;boru o &uacute;\u010dasti n&aacute;hradn&eacute;ho \u010dlena, n&aacute;hradn&yacute; \u010dlen sa nezapo\u010d&iacute;tava do po\u010dtu pr&iacute;tomn&yacute;ch \u010dlenov v&yacute;boru a nem&aacute; pr&aacute;vo hlasova\u0165. N&aacute;hradn&yacute; \u010dlen za predsedu v&yacute;boru alebo podpredsedu v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti sa na sch&ocirc;dzi v&yacute;boru z&uacute;\u010dast\u0148uje ako \u010dlen v&yacute;boru (8).<br \/>Na rokovan&iacute; v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti sa m&ocirc;\u017eu z&uacute;\u010dast\u0148ova\u0165 aj poslanci Eur&oacute;pskeho parlamentu zvolen&iacute; na &uacute;zem&iacute; Slovenskej republiky, pri\u010dom maj&uacute; pr&aacute;vo vyjadrova\u0165 sa k prerok&uacute;vanej veci, ak po\u017eiadaj&uacute; o slovo. Na rokovan&iacute; v&scaron;ak nemaj&uacute; pr&aacute;vo hlasova\u0165.<\/p>\r\n<p style=\"text-align: justify;\"><strong>P&ocirc;sobnos\u0165 v&yacute;boru<\/strong><\/p>\r\n<p style=\"text-align: justify;\">V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti:<br \/>a) prerok&uacute;va n&aacute;vrhy pr&aacute;vne z&aacute;v&auml;zn&yacute;ch aktov a in&yacute;ch aktov Eur&oacute;pskej &uacute;nie,<br \/>b) schva\u013euje stanovisk&aacute; Slovenskej republiky k n&aacute;vrhom pod\u013ea p&iacute;smena a), o ktor&yacute;ch bud&uacute; rokova\u0165 pr&iacute;slu&scaron;n&eacute; org&aacute;ny Eur&oacute;pskej &uacute;nie,<br \/>c) posudzuje s&uacute;lad n&aacute;vrhov legislat&iacute;vnych aktov Eur&oacute;pskej &uacute;nie so z&aacute;sadou subsidiarity vr&aacute;tane schva\u013eovania od&ocirc;vodnen&yacute;ch stanov&iacute;sk,<br \/>d) prerok&uacute;va n&aacute;vrhy \u017eal&ocirc;b vo veci poru&scaron;enia z&aacute;sady subsidiarity legislat&iacute;vnym aktom Eur&oacute;pskej &uacute;nie,<br \/>e) prerok&uacute;va spr&aacute;vy a inform&aacute;cie predkladan&eacute; n&aacute;rodnej rade vl&aacute;dou a \u010dlenmi vl&aacute;dy a akty predkladan&eacute; n&aacute;rodnej rade org&aacute;nmi Eur&oacute;pskej &uacute;nie,<br \/>f) m&ocirc;\u017ee po\u017eiada\u0165 ostatn&eacute; v&yacute;bory n&aacute;rodnej rady o ich stanovisk&aacute; k n&aacute;vrhom pod\u013ea p&iacute;smen a) a b),<br \/>g) pod&aacute;va n&aacute;rodnej rade spr&aacute;vy o \u010dinnosti pod\u013ea p&iacute;smen a) a\u017e f) (9).<br \/>N&aacute;rodn&aacute; rada si v&scaron;ak m&ocirc;\u017ee vyhradi\u0165 rozhodnutie o z&aacute;le\u017eitostiach pod\u013ea p&iacute;sm. a) a\u017e c). <br \/>T&yacute;mto sa ponech&aacute;va n&aacute;rodnej rade mo\u017enos\u0165, aby si v pr&iacute;padoch osobitnej d&ocirc;le\u017eitosti vyhradila rozhodnutie vo veciach zveren&yacute;ch do p&ocirc;sobnosti v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti.<br \/>Z vy&scaron;&scaron;ie uveden&eacute;ho je zrejm&eacute;, \u017ee v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti m&ocirc;\u017ee po\u017eiada\u0165 aj ostatn&eacute; v&yacute;bory n&aacute;rodnej rady (tzv. vecn&eacute; v&yacute;bory) o stanovisk&aacute; k n&aacute;vrhom pr&aacute;vne z&aacute;v&auml;zn&yacute;ch aktov a in&yacute;ch aktov E&Uacute; a k n&aacute;vrhom stanov&iacute;sk Slovenskej republiky k t&yacute;mto n&aacute;vrhom. <br \/>Spolupr&aacute;ca v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti s vecn&yacute;mi v&yacute;bormi vo veciach podstaty n&aacute;vrhov pr&aacute;vnych aktov E&Uacute; a n&aacute;vrhov stanov&iacute;sk Slovenskej republiky k nim je be\u017enou praxou a umo\u017e\u0148uje zoh\u013eadni\u0165 &scaron;ir&scaron;ie spektrum odborn&yacute;ch a politick&yacute;ch n&aacute;zorov. <br \/>O stanovisko vecn&eacute;ho v&yacute;boru v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti po\u017eiada spravidla vtedy, ak gestorsk&eacute; ministerstvo ozna\u010d&iacute; n&aacute;vrh ako prioritn&yacute; (s vysokou d&ocirc;le\u017eitos\u0165ou) z poh\u013eadu z&aacute;ujmov Slovenskej republiky. <br \/>Napr&iacute;klad ak sa n&aacute;vrh pr&aacute;vne z&aacute;v&auml;zn&eacute;ho aktu E&Uacute; prioritnej d&ocirc;le\u017eitosti t&yacute;ka problematiky financi&iacute;, m&ocirc;\u017ee v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti po\u017eiada\u0165 o odborn&eacute; stanovisko k podstate toho n&aacute;vrhu V&yacute;bor NR SR pre financie a rozpo\u010det a pod. <br \/>V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti potom pri \u010fal&scaron;om rokovan&iacute; o n&aacute;vrhu zoh\u013eadn&iacute; stanovisko vecn&eacute;ho v&yacute;boru k tomuto n&aacute;vrhu, ak bolo v&yacute;boru doru\u010den&eacute;.<br \/>Rokovac&iacute; poriadok neustanovuje, v ktorom &scaron;t&aacute;diu rozhodovac&iacute;ch procesov na &uacute;rovni E&Uacute; sa m&aacute; n&aacute;rodn&aacute; rada (resp. v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti) uveden&yacute;mi n&aacute;vrhmi zaobera\u0165, ponech&aacute;vaj&uacute;c tak aj toto na rozhodnut&iacute; samotnej n&aacute;rodnej rady resp. v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti. <br \/>Predseda v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti priebe\u017ene zarad&iacute; do n&aacute;vrhu programu sch&ocirc;dze n&aacute;vrhy pr&aacute;vnych aktov E&Uacute;, ktor&eacute; boli v&yacute;boru doru\u010den&eacute;, spravidla tak, aby v&yacute;bor mohol v pr&iacute;pade n&aacute;vrhov legislat&iacute;vnych aktov presk&uacute;ma\u0165 ich s&uacute;lad so z&aacute;sadou subsidiarity do &ocirc;smich t&yacute;\u017ed\u0148ov od ich doru\u010denia. <br \/>V praxi to znamen&aacute;, \u017ee v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti je pravidelne informovan&yacute; o nov&yacute;ch n&aacute;vrhoch pr&aacute;vnych aktov E&Uacute; formou tabu\u013eky s nov&yacute;mi n&aacute;vrhmi. Tabu\u013eka obsahuje inform&aacute;ciu o stru\u010dnom obsahu n&aacute;vrhu, kedy kon\u010d&iacute; lehota na pos&uacute;denie s&uacute;ladu so z&aacute;sadou subsidiarity, inform&aacute;ciu o d&ocirc;le\u017eitosti n&aacute;vrhu z poh\u013eadu z&aacute;ujmov Slovenskej republiky a odpor&uacute;\u010danie Odboru pre eur&oacute;pske z&aacute;le\u017eitosti kancel&aacute;rie n&aacute;rodnej rady, \u010di sa m&aacute; v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti n&aacute;vrhom \u010falej zaobera\u0165 a akou formou.<br \/>Ako bolo vysvetlen&eacute; vy&scaron;&scaron;ie, Lisabonsk&aacute; zmluva zav&aacute;dza pr&aacute;vo n&aacute;rodn&yacute;ch parlamentov dohliada\u0165 prostredn&iacute;ctvom syst&eacute;mu v\u010dasn&eacute;ho varovania nad dodr\u017eiavan&iacute;m z&aacute;sady subsidiarity v n&aacute;vrhoch legislat&iacute;vnych aktov E&Uacute;. <br \/>Ke\u010f\u017ee n&aacute;rodn&aacute; rada zverila svoje pr&aacute;vomoci v oblasti eur&oacute;pskych z&aacute;le\u017eitost&iacute; v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti, pr&aacute;ve tento v&yacute;bor m&aacute; mo\u017enos\u0165 kontrolova\u0165 s&uacute;lad spom&iacute;nan&yacute;ch n&aacute;vrhov pr&aacute;vnych aktov E&Uacute; z h\u013eadiska ich s&uacute;ladu so z&aacute;sadou subsidiarity. <br \/>Ak sa n&aacute;rodn&aacute; rada (v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti) v osemt&yacute;\u017ed\u0148ovej lehote stanovenej Lisabonskou zmluvou uznesie na tom, \u017ee konkr&eacute;tny n&aacute;vrh legislat&iacute;vneho aktu E&Uacute; nie je v s&uacute;lade so z&aacute;sadou subsidiarity, za&scaron;le pr&iacute;slu&scaron;n&yacute;m in&scaron;tit&uacute;ci&aacute;m E&Uacute; od&ocirc;vodnen&eacute; stanovisko uv&aacute;dzaj&uacute;ce, pre\u010do sa domnieva, \u017ee dan&yacute; n&aacute;vrh nie je <br \/>v s&uacute;lade so z&aacute;sadou subsidiarity. Ak predlo\u017een&eacute; od&ocirc;vodnen&eacute; stanovisk&aacute; zodpovedaj&uacute; potrebnej v&auml;\u010d&scaron;ine hlasov priraden&yacute;ch n&aacute;rodn&yacute;m parlamentom, uplatn&iacute; sa mechanizmus \u017eltej alebo oran\u017eovej karty pop&iacute;san&yacute; v prvej \u010dasti tejto kapitoly.<br \/>Okrem uveden&yacute;ch blokuj&uacute;cich prostriedkov m&ocirc;\u017eu n&aacute;rodn&eacute; parlamenty iniciova\u0165 s&uacute;dnu kontrolu dodr\u017eiavania z&aacute;sady subsidiarity, a to podan&iacute;m n&aacute;vrhu na S&uacute;dny dvor E&Uacute; na za\u010datie osobitn&eacute;ho typu konania o neplatnosti legislat&iacute;vneho aktu. <br \/>V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti alebo najmenej p&auml;tina poslancov n&aacute;rodnej rady m&ocirc;\u017ee p&iacute;somne po\u017eiada\u0165 n&aacute;rodn&uacute; radu, aby sa uzniesla na podan&iacute; \u017ealoby vo veci poru&scaron;enia z&aacute;sady subsidiarity legislat&iacute;vnym aktom E&Uacute;. <br \/>N&aacute;vrh \u017ealoby mus&iacute; obsahova\u0165 presn&eacute; znenie \u017ealoby, na ktorej sa m&aacute; n&aacute;rodn&aacute; rada uznies\u0165. N&aacute;vrh \u017ealoby sa predklad&aacute; predsedovi n&aacute;rodnej rady, a to najnesk&ocirc;r p&auml;tn&aacute;sty de\u0148 pred uplynut&iacute;m lehoty na podanie \u017ealoby, pri\u010dom \u010fal&scaron;ie n&aacute;le\u017eitosti bli\u017e&scaron;ie upravuje &sect; 58b z&aacute;kona o rokovacom poriadku.<\/p>\r\n<p style=\"text-align: justify;\"><strong>Predbe\u017en&eacute; stanovisko<\/strong><\/p>\r\n<p style=\"text-align: justify;\">Cie\u013eom predbe\u017en&eacute;ho stanoviska je na &uacute;vod legislat&iacute;vneho procesu na &uacute;rovni E&Uacute; definova\u0165 v&yacute;chodiskov&eacute; poz&iacute;cie Slovenskej republiky a ur\u010di\u0165 n&aacute;rodn&eacute; priority pre nasleduj&uacute;cu diskusiu. <br \/>Predbe\u017en&eacute; stanovisko je v&yacute;chodiskov&yacute;m dokumentom pre z&aacute;stupcu Slovenskej republiky v diskusi&aacute;ch v pracovn&yacute;ch skupin&aacute;ch Rady. Pripravuje ho zodpovedaj&uacute;ci &uacute;stredn&yacute; org&aacute;n &scaron;t&aacute;tnej spr&aacute;vy a schva\u013euje pr&iacute;slu&scaron;n&aacute; Rezortn&aacute; koordina\u010dn&aacute; skupina (t.j. expertn&aacute; skupina, ktor&aacute; koordinuje rozhodovac&iacute; proces v z&aacute;le\u017eitostiach E&Uacute; na &uacute;rovni ministerstva alebo in&eacute;ho &uacute;stredn&eacute;ho org&aacute;nu &scaron;t&aacute;tnej spr&aacute;vy). Vl&aacute;da alebo poveren&yacute; \u010dlen vl&aacute;dy najnesk&ocirc;r &scaron;tyri t&yacute;\u017edne po obdr\u017ean&iacute; n&aacute;vrhu pr&aacute;vneho aktu a n&aacute;vrhu legislat&iacute;vneho aktu E&Uacute; predklad&aacute; v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti predbe\u017en&eacute; stanovisko k tomuto n&aacute;vrhu. Predbe\u017en&eacute; stanovisko je pozi\u010dn&yacute;m dokumentom vl&aacute;dy (ministerstva), ktor&yacute; obsahuje prim&aacute;rne hodnotenie predlo\u017een&eacute;ho n&aacute;vrhu v po\u010diato\u010dnom &scaron;t&aacute;diu legislat&iacute;vneho procesu na &uacute;rovni E&Uacute;.<br \/><br \/>V&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti sa m&ocirc;\u017ee s hodnoten&iacute;m s&uacute;ladu n&aacute;vrhu so z&aacute;sadou subsidiarity v predbe\u017enom stanovisku stoto\u017eni\u0165 a s predlo\u017een&yacute;m predbe\u017en&yacute;m stanoviskom vyslovi\u0165 s&uacute;hlas, alebo v opa\u010dnom pr&iacute;pade, m&ocirc;\u017ee \u010dlena vl&aacute;dy zaviaza\u0165 presadzova\u0165 v Rade in&uacute; poz&iacute;ciu (napr. namieta\u0165 poru&scaron;enie z&aacute;sady subsidiarity).<\/p>\r\n<p style=\"text-align: justify;\"><strong>Stanovisko Slovenskej republiky<\/strong><\/p>\r\n<p style=\"text-align: justify;\">Stanovisko Slovenskej republiky predstavuje n&aacute;rodn&eacute; stanovisko na diskusiu alebo rozhodnutie na zasadnutia Rady. N&aacute;vrh stanoviska Slovenskej republiky na rokovanie Rady pripravuje gestorsk&yacute; rezort na z&aacute;klade dovtedy spracovan&yacute;ch materi&aacute;lov (predbe\u017en&eacute; stanovisko, poz&iacute;cia a in&scaron;trukcia) a na z&aacute;klade v&yacute;sledkov rokovan&iacute; pr&iacute;slu&scaron;n&yacute;ch Pracovn&yacute;ch skup&iacute;n Rady, v&yacute;borov Rady a V&yacute;boru st&aacute;lych z&aacute;stupcov (tzv. COREPER). N&aacute;vrh stanoviska schva\u013euje zodpovedn&yacute; minister alebo ved&uacute;ci predstavite\u013e in&eacute;ho &uacute;stredn&eacute;ho org&aacute;nu &scaron;t&aacute;tnej spr&aacute;vy, pri\u010dom pred schv&aacute;len&iacute;m je n&aacute;vrh predmetom rokovania Komisie pre eur&oacute;pske z&aacute;le\u017eitosti, ktor&aacute; p&ocirc;sob&iacute; na Ministerstve zahrani\u010dn&yacute;ch vec&iacute; a eur&oacute;pskych z&aacute;le\u017eitost&iacute; SR a je hlavn&yacute;m expertn&yacute;m medzirezortn&yacute;m koordina\u010dn&yacute;m org&aacute;nom v oblasti tvorby stanov&iacute;sk k n&aacute;vrhom pr&aacute;vnych aktov E&Uacute;.<br \/>Vl&aacute;da alebo poveren&yacute; \u010dlen vl&aacute;dy v dostato\u010dnom \u010dasovom predstihu predklad&aacute; v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti n&aacute;vrh stanoviska Slovenskej republiky k n&aacute;vrhom pr&aacute;vne z&aacute;v&auml;zn&yacute;ch aktov a in&yacute;ch aktov E&Uacute;, pri\u010dom v tejto veci je povinn&yacute; <br \/>z&uacute;\u010dastni\u0165 sa na rokovan&iacute; v&yacute;boru a informova\u0165 ho (10).<br \/>Ak v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti schv&aacute;li n&aacute;vrh stanoviska Slovenskej republiky, je \u010dlen vl&aacute;dy t&yacute;mto stanoviskom viazan&yacute; pri zastupovan&iacute; Slovenskej republiky v pr&iacute;slu&scaron;nom org&aacute;ne E&Uacute;. <br \/>\u010clen vl&aacute;dy sa m&ocirc;\u017ee od stanoviska Slovenskej republiky odch&yacute;li\u0165 len v nevyhnutnom pr&iacute;pade a so zrete\u013eom na z&aacute;ujmy Slovenskej republiky; v takom pr&iacute;pade je povinn&yacute; o tom bezodkladne informova\u0165 v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti a tak&yacute;to postup od&ocirc;vodni\u0165. <br \/>\u010clen vl&aacute;dy m&ocirc;\u017ee po\u017eiada\u0165 v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti o zmenu stanoviska Slovenskej republiky (11). Ak sa v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti nevyjadr&iacute; k n&aacute;vrhu stanoviska Slovenskej republiky do dvoch t&yacute;\u017ed\u0148ov od jeho predlo\u017eenia, \u010dlen vl&aacute;dy je viazan&yacute; (predlo\u017een&yacute;m) n&aacute;vrhom stanoviska Slovenskej republiky (12). Mo\u017enos\u0165 sa ku n&aacute;vrhu stanoviska nevyjadri\u0165 (tzv. princ&iacute;p tichej proced&uacute;ry) je prejavom mo\u017enosti stanovisko vzia\u0165 na vedomie resp. &bdquo;ml\u010dky&ldquo; <br \/>ods&uacute;hlasi\u0165 a v&ocirc;bec ho neprerokov&aacute;va\u0165 ani explicitne neschva\u013eova\u0165.<br \/>Ak v&yacute;bor pre eur&oacute;pske z&aacute;le\u017eitosti neschv&aacute;li n&aacute;vrh stanoviska Slovenskej republiky a z&aacute;rove\u0148 neschv&aacute;li v danej veci in&eacute; stanovisko, \u010dlen vl&aacute;dy je viazan&yacute; (p&ocirc;vodn&yacute;m) n&aacute;vrhom stanoviska Slovenskej republiky (13). Tento princ&iacute;p je analogick&yacute; k tzv. princ&iacute;pu kon&scaron;trukt&iacute;vneho nes&uacute;hlasu.<\/p>\r\n<p style=\"text-align: justify;\"><strong>Spr&aacute;va o z&aacute;le\u017eitostiach s&uacute;visiacich s \u010dlenstvom Slovenskej republiky v E&Uacute;<\/strong><\/p>\r\n<p style=\"text-align: justify;\">Vl&aacute;da zabezpe\u010d&iacute; pravideln&eacute; informovanie v&yacute;boru pre eur&oacute;pske z&aacute;le\u017eitosti \u010dlenmi vl&aacute;dy o aktu&aacute;lnych ot&aacute;zkach, ktor&eacute; s&uacute; prerok&uacute;van&eacute; v org&aacute;noch E&Uacute;, ktor&yacute;ch s&uacute; \u010dlenmi.
